Disclaimer*	Rules for Use of Textbooks Article 1. Scope of Rules These Rules shall apply to all matters relating to the utilization of our textbooks on the JPO Cooperation in Human Resource Development homepage (hereinafter referred to as the "textbooks") provided to members by Asia-Pacific Industrial Property Center (APIC), Japan Institute of Invention and Innovation. Article 2. Content of Services Any party wishing to use our textbooks (hereinafter referred to as "User") may freely do so, with the exception of items not in line with Article III. Article 3. Ban of Services In using the textbooks, Users shall refrain from performing any of the following acts: (1) Utilizing or providing the textbooks to outside parties for the purpose of financial gain (2) Infringing upon the copyrights or any other rights of APIC or third parties with respect to duplicating, translating, publishing, selling, sending, loaning, distributing, or altering the textbooks (whether in full or any portion thereof) (3) Obstructing the operation of Services (4) Breaching any provision under the Rules (5) Performing any other act that APIC judges to be improper Article 4. Discontinuation/Suspension of Services Clause 1. Upon occurrence of any of the following, APIC may discontinue or suspend the Services, in part or in whole, without having to provide notice of such : (1) When due to a natural disaster, or any other similar cause, the Services can not be provided; or (2) When maintenance or renewal is done in an emergency; or (3) When due to any improper access to the Services through the Internet, it has become impossible to further provide them; or (4) When any other event takes place, making provision of the Services difficult. Clause 2. In the event of any damage incurred by APIC and others as a result of any of the preceding acts, APIC shall not be liable for any and all damages incurred by Users and/or third parties. Article 5. Discloser of Access log Upon occurrence of any of the following, APIC may provide a User's personal information for third parties. (1) When Users agree to have such information provided; or (2) In response to subpoenas, court orders, or legal procedures, or to establish or exercise our legal rights, or defend against legal claims; or (3) When it derives from a need to protect APIC's or a third parties' rights or property based on a violation of these Rules; or (4) When it derives from an immediate need based on danger to a parties' life or person. Article 6. Escape Clause 1. The User agrees to the following. (1) That APIC bears no responsibility regarding whether the term messages are posted and whether they are erased or saved, (2) APIC shall not assume any liability for any damage out of or in relation to any provision under these Rules and/or the Services. Article 7. Governing Law These rules shall be interpreted and construed in accordance with the laws of Japan. Any conflicts arising between third parties, users, and/or APIC shall be settled in a district court of Tokyo. Article 8. Amendment and repeal of the Rule APIC may amend or repeal any provision of the Rules. The Rules shall take effect as from January 31, 2007.
